Hello and welcome to my website!My name is Mossling, and I am a freelance digital artist with a focus on illustrations and character design. I enjoy creating monstrous and cute creatures, custom/original species, and delving into the world of fantasy and sci-fi. Terms of Service



SECTION I. General Terms

  • Price Changes: My prices will adjust over time, however commissions made prior to each adjustment will be unaffected by these changes.

  • Agreement: By ordering a digital artwork, you agree that you are over the age of 18 and have read through, understood, and fully agree to my Terms of Service. Similarly, you also agree that you have understood that the artwork commissioned is a digital good and cannot be shipped physically. You will receive it as a digital file.

  • Communication: Potential clients are encouraged to reach out to me via Discord (Mossling.) for the fastest response time. The discussion of the commission and all progress reports, questions, concerns, or otherwise will be handled either via email or Discord (Mossling.). Please note that response times may vary.

  • Not First Come, First Serve: Commissions are not handled at a first come, first serve basis. I only take on a few commission at a time with limited slots and will choose the orders I feel the most inspiration for. Those with specific deadlines or other limitations will be done first, but are otherwise worked on in order of when they were paid and finalized. A rush fee can be added to your commission if you wish for it to be completed by a specific date, however this must be discussed prior to ensure the feasibility of meeting the proposed deadline.

  • Time of Completion: The completion time of each work varies depending on the complexity of the character and details of the background, outfit(s), etc. I will rarely take more than a few weeks for small images, but for large scale, fully illustrated, works this can take up to several months or more. I also work full time and my time is limited. Should this be the case, wherein there is a delay in the progress of your commission, you will be notified and kept up to date, but please be patient. This timeframe applies only after the commission has paid for and officially started.

  • Delays: Health issues, COVID restrictions, and the like can impact the speed in which commissions are completed. Should this occur, you will be informed of the situation asap. It is strongly advised that clients follow my Trello, Twitter, or are apart of my discord server in the event of any issues that may cause unforeseen delays.

  • Absences: If the client suddenly disappears without any warning for an extended period of time (1 month), any in-progress work will be paused until communication has been restablished. If the client does not respond after a total of 2 months has elasped, the commission will be cancelled. Repeated offenders will be blacklisted and reported.

  • Streams: I sometimes stream while working on commissions and will notify you through a message if yours is currently being worked on.


SECTION II. IMAGE COPYRIGHT

  • Copyrights: I, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own or use it for any purpose beyond a personal use. This is for the purpose of copyright protection. I reserve the right to advertise this artwork in any way, shape, or form to promote my work. To purchase the full rights of the image, please make sure to disclose this during the processing of your order, as this is evaluated on a case by case basis and the final quote may vary.

  • Image Use: All commissioned artwork is for noncommercial purposes only. Redistribution of my artwork for use in printed merchandise, promotion of goods, services, social media pages, or in the use of training AI and other generative tools is strictly prohibited. If you have any questions or concerns regarding this, it is your responsibility to ask for clarification prior to commissioning me.

  • Reposting: The client has permission to repost the artwork wherever they would like so long as proper credit is given and my watermark/signature remains intact and unaltered. For more information, please review the Use of Artwork section.

  • Privacy of Work: I must be notified at the start of the commission on whether or not you wish for the finished artwork to be kept private and for how long (maximum 1 month after completion). All orders that do not have this specified will have the artwork posted publicly shortly after completion. If you wish for the artwork to not be posted publicly for an extended period of time, or permanently, you must purchase the full copyright.


SECTION III. PAYMENT INFORMATION

  • Payment Upfront: Payment must be made upfront in order for work to begin.

  • Partial Payments: Partial payments are only accepted for orders that exceed 200 USD. Half will be received at the beginning of the order and the second half given after the initial sketching phase/concept has been approved by the client.

  • Invoice and USD Only: All orders and related payment are made via invoice and in USD.

  • 24hr Limit: Failure to pay the invoice within 24 hours will result in the cancellation of the order and forfeiting of the client's commission slot. Any progress made, if any, will be repurposed as a YCH. Similarly, it is the commissioner's responsibility to notify me when payment has been sent. Failure to do so before the 24hr deadline will result in cancellation if it is clear the payment has not gone through.


SECTION IV. Refund Policy

  • Early Cancellations: If the commission is cancelled by either I, the artist, or the client and prior to the start of any work, then the client will receive a full refund.

  • Mid-Work Cancellations: If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion. If a refund is granted, it will only be a partial one with the remainder proportionate to the amount of time, materials, and other assets used.

  • Near/Post Completion Cancellations: No refunds will be given for completed or nearly completed commissions.

  • Artist Cancellations: The artist reserves the right to cancel a commission at any time, for any reason, and without explanation. If I cancel the commission due to my inability to complete it at any stage (be it for health reasons or otherwise), a full refund will be given.

  • If a commission is canceled, I reserve the right to recycle, reuse, and otherwise repurpose sketches and other aspects of the work so that they might be utilized in YCH auctions and so on.


SECTION V. Use of Artwork

  • You are not allowed to claim any of my artworks as your own.

  • You are not to resell or profit from any of my artworks.

  • You are not allowed to edit my artworks in any way. Resizing the image is allowed but credit must be clearly visible.

  • You are not allowed to recolor, trace, or repaint my artwork in any way, shape, or form.

  • You are not allowed to use my artwork in generative AI for training, learning, or otherwise destructive, reformative, creative and/or other purposes.

  • You are not allowed to remove, crop, blur, or edit in any way the watermark of any of my artworks.

  • When reposting my artwork, you must clearly give credit and directly link back to my Twitter or other official social media.

  • You are responsible for saving the artwork after it has been completed. I have limited space on my computer and will not store files of each order for long periods of time.


SECTION VI. Commssion Process

  • Artistic Freedom: While I am happy to accomodate and work with the vision of the commissioner to accurately portray the character(s) for whom I am making the artwork of, I ask that room be given in the way of variation. I work best when given some form of artistic freedom.

  • Work In Progress (WIPs): Certain commission types may or may not include a sketch approval stage. For those that do, a progress image will be sent either via email of Discord. After it has been sent, progress will be paused until the sketch has been confirmed and both the artist and commission have agreed upon continuing.

  • Revisions and Edits: The client is granted two revisions per commission. Any major changes or revisions of the artwork must be done in the sketch stage, including (but not limited to) changes in the character's pose, body shape, outfit, alignment of accessories (large and small), and roughing of the background. Once approved, no further significant edits may be made to the overall composition. If the commissioner requests further changes, both those that exceed the two granted revisions and those requested post-sketch phase, there will be an additional fee.

  • Errors: In the event of an error, I will happily fix any mistakes I may have made and overlooked during the creation of the artwork. However, if this error is due to an outdated reference, unclear information, lack of a proper reference or color palette, the client will be charged an amount appropriate to the size and complexity of the correction(s).

  • References: It falls upon the client to provide an accurate and consistent reference for the character(s) and/or scene they wish to be depicted. Should the client not have a reference, they will be asked for a clear and concise description with any other supplementary materials. An additional fee will also be charged. The use of a gallery


SECTION VII. Restrictions

If you are interested in commissioning me, reviewing this list prior to filling out your commission form is necessary. If you wish for further clarification on any given item, feel free to reach out and I will be more than happy to answer any questions.Please keep in mind that my style is my own and that I will not attempt to replicate the style of another artist or company aesthetic (E.g Disney, Nintendo, etc). In regard to NSFW content, and commissioning me in general, you must be over the age of 18 to order.

What I Will Not Draw

  • Extreme gore

  • Hateful or otherwise offensive content

  • Politicaly charged content

  • Negative religious themes

  • Non-Consensual content

  • Extreme kink/fetish content (Ask)
